Terms of Service

1. Acceptance of Terms

By accessing or using RapidCaster ("the Service") at therapidcaster.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

RapidCaster is a content repurposing platform that allows creators to upload podcast episodes and video recordings and receive automatically generated content outputs including short-form clips, newsletters, social media posts, show notes, and transcripts.

3. Your Account

You must sign in with a Google account to use RapidCaster. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately of any unauthorized use of your account.

You must be at least 13 years old to use the Service. By using RapidCaster, you represent that you meet this requirement.

4. Your Content

You retain full ownership of all content you upload to RapidCaster. By uploading content, you grant us a limited, non-exclusive license to process and store that content solely for the purpose of delivering the Service to you.

You represent and warrant that:

• You own or have the necessary rights to the content you upload
• Your content does not infringe any third-party intellectual property, privacy, or other rights
• Your content does not violate any applicable law

We reserve the right to remove content that violates these terms or that we are legally required to remove.

5. Acceptable Use

You agree not to use RapidCaster to:

• Upload content you do not have the right to use
• Upload illegal content, or content that promotes violence, hate, or harassment
• Attempt to circumvent, reverse engineer, or exploit the Service
• Use the Service in any way that could damage, overload, or impair our infrastructure
• Resell or redistribute the Service without our written consent

6. Billing and Subscriptions

RapidCaster offers a free tier and paid subscription plans. Paid plans are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months.

We reserve the right to change pricing with 30 days' notice to active subscribers.

7. Intellectual Property

The RapidCaster name, logo, application design, and all underlying technology are owned by RapidCaster and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

The content outputs generated from your uploads are yours. We make no claim to ownership of the clips, newsletters, captions, or other outputs derived from your content.

8. AI-Generated Content

RapidCaster uses artificial intelligence (Anthropic Claude) to generate content outputs including summaries, clip suggestions, newsletters, social media captions, show notes, blog posts, and other text. You acknowledge and agree that:

• AI-generated content is provided as a starting point and may require your review and editing before use
• AI outputs are not guaranteed to be accurate, complete, or free of errors
• You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing or distributing it
• RapidCaster is not liable for any consequences arising from the use of AI-generated content without adequate review
• AI-generated content should not be considered professional, legal, medical, or financial advice

9. Email and SMS Messaging

RapidCaster provides tools for sending emails and SMS messages to your contacts (e.g., newsletter distribution, CRM outreach). By using these features, you agree that:

• You are solely responsible for complying with all applicable laws, including the CAN-SPAM Act (for email) and the Telephone Consumer Protection Act / TCPA (for SMS)
• You will only send messages to recipients who have provided proper consent to receive communications from you
• You will include accurate sender information and honor opt-out/unsubscribe requests promptly
• You will not use RapidCaster's messaging features to send spam, unsolicited bulk messages, or deceptive content
• RapidCaster is not responsible for your compliance with messaging laws and regulations

Violation of these terms may result in immediate suspension or termination of your messaging capabilities and/or your account.

10. Content Ownership and License

You retain full ownership of all content you upload to RapidCaster, including videos, audio files, and any text you create. By using the Service, you grant RapidCaster a limited, non-exclusive, non-transferable license to:

• Process, transcribe, and analyze your content using our systems and third-party AI services
• Store your content and generated outputs on our servers
• Create derivative works (clips, summaries, newsletters, etc.) as directed by you through the Service

This license exists solely for the purpose of providing the Service to you. We do not claim ownership of your content or the outputs generated from it. You may delete your content at any time, which terminates our license to that content.

11. Fair Use Policy

RapidCaster is designed for legitimate content creation and repurposing. You agree not to use the Service for:

• Generating or distributing spam content at scale
• Creating misleading, deceptive, or fraudulent content
• Processing content that promotes violence, hate speech, harassment, or discrimination
• Uploading or processing illegal content, including content that violates copyright, privacy, or other laws
• Automating the Service in ways that circumvent usage limits or degrade performance for other users
• Reselling access to the Service or its outputs without our written consent

We reserve the right to investigate potential violations and take appropriate action, including content removal, account suspension, or termination, at our sole discretion.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely accurate. Use of the Service is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, RapidCaster shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, abuse of the Service, or any other reason at our sole discretion. You may delete your account at any time by contacting support@therapidcaster.com.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will update the "Last updated" date when changes are made.

16. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in a court of competent jurisdiction.
