1. Respect for Intellectual Property

RapidCaster respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond promptly to notices of alleged copyright infringement that comply with the DMCA and any other applicable intellectual property laws.

2. User Responsibility

Users are solely responsible for the content they upload, process, or distribute through RapidCaster. By using the Service, you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize RapidCaster to process all content you submit.

You agree not to upload, process, or distribute any content that infringes or violates the intellectual property rights or any other rights of any third party.

3. Filing a DMCA Takedown Notice

If you believe that content hosted on or processed through RapidCaster infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include all of the following:

  • Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
  • Identification of the infringing material — A description of the material you claim is infringing, with enough detail for us to locate it (e.g., a URL or specific description).
  • Your contact information — Your name, mailing address, telephone number, and email address.
  • Good faith statement — A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • Accuracy statement — A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  • Signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

4. DMCA Agent Contact

We aim to review and respond to all valid DMCA notices within 2 business days.

5. Counter-Notification

If you believe that content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include:

  • Identification of the removed material — A description of the material that was removed and the location where it appeared before removal.
  • Good faith statement — A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, any judicial district in which RapidCaster may be found, and that you will accept service of process from the person who provided the original DMCA notice.
  • Your contact information — Your name, address, telephone number, and email address.
  • Signature — Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant and restore the removed material within 10-14 business days unless the complainant notifies us that they have filed a court action.

6. Repeat Infringer Policy

RapidCaster maintains a policy of terminating the accounts of users who are repeat infringers of copyright. If a user receives multiple valid DMCA takedown notices, we may, at our sole discretion:

  • Issue a warning to the user
  • Temporarily suspend the user's account
  • Permanently terminate the user's account

We consider the circumstances of each case and may take action after as few as two valid notices.

7. Misrepresentation Warning

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorney fees.
